PRESS STATEMENT: PPRA ON THE COURT ORDER ON THE MATTER BETWEEN MAMODUPI MOHLALA- MULAUDZI AGAINST THE MINISTER OF HUMAN SETTLEMENTS AND THE PPRA
The Board of the Property Practitioners Regulatory Authority ( PPRA ) welcomes the decision of the court handed down on the 14th of April 2022, putting to rest with certainty the unwarranted assertion that the PPRA Board was unlawfully and illegally appointed. In the same token, the court’s decision dismisses the assertion that the precautionary suspension of Ms. Mohlala-Mulaudzi was unlawful and ultra vires.
The Court upheld that the primary trigger for litigation was the “precautionary suspension” of the applicant by the Board. With the court ruling that the exercise of powers by the Minister was in fact, lawful and legal, thus the appointment by the Minister on 26 November 2021 remains valid. It therefore follows that the PPRA Board is entitled to the exercise of the powers conferred to it by the Property Practitioners Act, including the power to place Ms. Mohlala–Mulaudzi on precautionary suspension, as exercised on 25th March 2022. The Court accordingly dismissed the challenge by Ms. Mohlala-Mulaudzi.
We are of the firm view that the PPRA continue with the investigation in relation to the allegations levelled by the whistleblower against Ms. Mohlala-Mulaudzi. The investigation will continue as specified below allowing for an objective, independent, impartial and transparent process.
The investigation does not, in any way, declare with certainty that there was any wrong doing on the part of Ms. Mohlala-Mulaudzi. The investigation is rather intended at bringing about a justified finality to these allegations.
The PPRA remains committed to discharging its responsibilities notwithstanding the violent acts of intimidation metered against our staff members, the unfounded negative assertions, which can only be intended at deterring the PPRA Board from discharging its duties and responsibilities , particularly as its relates to the investigations into the serious allegations.
The PPRA is now looking forward with great eagerness to serve the consumers and all its stakeholders with diligence and relentless effectiveness. Primarily on the PPRA agenda is true transformation to a material and significant level of the property sector. Our efforts are focused on the initiatives to ensure that the transformation project is a success.
